It might not be the most exciting part, but this Warranty is here to ensure the rules under which We support and cover Your Products are crystal clear. It tells You who We are, how Your warranty coverage works, what to do if there is a problem, and other important information that You do not want to miss. Please ensure that You carefully read and understand these terms so You can make the best use of Your coverage.

1. Who we are
1.1 FairPhone B.V., a Dutch limited liability company located at Van Diemenstraat 200, 1013 CP, Amsterdam, The Netherlands, registered with the Trade Registry under number 55901964 (“Fairphone”, “Us”, “We” or “Our”), warrants to the original first end-user purchaser that Fairphone hardware products and spare parts are free from defects in design, materials, and workmanship during the applicable Warranty Period (encompassing both the Standard Warranty Period and, where validly registered, the Extended Warranty Period as defined herein) when used normally and in accordance with all operating instructions (“Normal Customer Use”).
1.2 This Warranty is granted to You as the original purchaser and may be transferred to a subsequent owner solely under the conditions set forth in Section 5.4 of this document.
2. What products are covered by the Warranty and for how long?
2.1 To ensure complete clarity, this document addresses two separate levels of consumer protection. Understanding the distinction between Your mandatory statutory legal rights and Fairphone’s voluntary commercial warranty is essential:
- Statutory Legal Guarantee of Conformity (Mandatory Protection)
- Legal Basis. Governed by EU Directive (EU) 2019/771, Directive 1999/44/EC, and mandatory national consumer protection legislation.
- Provider. The seller who sold You the Product (Fairphone if purchased via Our Online Shop, or Your Reseller).
- Duration & Cost. Provided entirely free of charge for a mandatory minimum period of two (2) years from physical delivery.
- Conditions. Applies automatically by law—no product registration is required.
- Statutory Repair Extension. In accordance with EU standards, if Your Product is repaired under statutory legal guarantee rights, Your statutory guarantee period is automatically extended by an additional twelve (12) months from repair completion, subject to applicable national laws.
- Fairphone Voluntary Commercial Warranty (Extended Warranty)
- Legal Basis. A voluntary commercial guarantee provided free of charge by FairPhone B.V. as a manufacturer.
- Provider. Granted directly by FairPhone B.V., regardless of whether You purchased directly from Our Online Shop or through a Reseller.
- Duration. Extends commercial coverage beyond the standard statutory period for eligible Products (including smartphones, batteries, audio devices, and charging accessories) in accordance with the specific durations, registration windows, and cut-off dates set forth in Section 7.
- Conditions. Operates in addition to, and independently of, Your statutory legal guarantee without replacing, limiting, or diminishing Your free statutory baseline protections. Extended Warranty coverage requires registration within the applicable Offer Period (as detailed in Section 7.1).
- Transferability. May be transferred to Second Owners for the remaining balance of the commercial coverage under Section 5.4.
2.2 For detailed information on Your statutory legal rights across the European Union, You can contact the European Consumer Center in Your country of purchase or residence.
3. The Fine Print, Translated
3.1 Just so that we are on the same page, capitalized terms used in this Warranty are defined in this section 3.1 or elsewhere in the document.
- "Covered Territory" means the continental territories of Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark (excluding Greenland), Estonia, Finland, France Métropolitaine (excluding overseas territories), Germany, Greece (excluding islands), Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Monaco, The Netherlands (excluding Bonaire, Saba, and St. Eustatius), Norway (excluding overseas territories), Poland, Portugal (excluding Azores and Madeira), Romania, San Marino, Slovakia, Slovenia, Spain (excluding Canary Islands, Ceuta, and Melilla), Sweden, Switzerland, and the United Kingdom (excluding the Channel Islands).
- “Customer” ("You", “Your” or "Yours") means any end-user residing within the Covered Territory who acquired a genuine Product for personal use, whether directly from Fairphone or through a Reseller.
- “Extended Warranty Cut-Off Date” means the absolute, final calendar date on which any applicable Extended Warranty coverage automatically terminates and expires.
- “Extended Warranty Duration” means the timeframe of additional commercial warranty coverage that applies immediately following the expiration of the standard Warranty period, subject to eligibility and mandatory registration.
- “Extended Warranty Offer Period” or “Offered Period” means the specific timeframe during which a Product must be purchased and/or registered to qualify for Extended Warranty coverage.
- “Extended Warranty Period” means The additional commercial coverage period granted upon valid registration under Section 7.1.
- "Non-Supported International Regions" means any location completely outside the geographic boundaries of the Covered Territory (such as Mexico or Canada). No logistical support or shipping reimbursement is provided for these regions.
- “Online Shop” means Our on-line shop section through which Fairphone Products are offered for sale, and where Customers can browse, order, and pay for those Products accessible at www.fairphone.com.
- "Out-of-Territory" means non-mainland, island, or remote regions within the Covered Territory statutory boundary (e.g., Malta, Cyprus, Canary Islands, Channel Islands, Ceuta, Melilla, Azores, Madeira). Fairphone provides after-sales warranty support for these regions under manual shipping reimbursement rules.
- "Product(s)" means the hardware products and associated software sold by Fairphone, including but not limited to smartphones, audio products and their spare parts and accessories.
- “Repair Portal”: Fairphone’s online self-service tool for warranty claims, technical service, and Dead on Arrival (DOA) requests, accessible at www.fairphone.com/repairs.
- “Registration Window” means the maximum timeframe of three (3) months following the store purchase date (for in-store retail sales) or physical delivery date (for online sales) during which an eligible Product must be registered to activate Extended Warranty coverage.
- "Reseller" means an authorized third-party sales partner or distributor explicitly permitted by Fairphone to sell the Product within the Covered Territory.
- “Second Owner” means any individual who receives or purchases a genuine Product second-hand from the original Customer within the Covered Territory.
- “Standard Warranty Period” means the initial baseline manufacturer warranty duration provided directly by Fairphone for a Product as set forth in Section 7, commencing on the date of physical delivery or store purchase receipt.
- “Warranty Period” means collectively the Standard Warranty Period and, where successfully registered, the Extended Warranty Period, subject to the specific limitations of each.
- “Website” means Fairphone’s official online presence accessible at www.fairphone.com, including all informational pages, blogs, support content, and company-related materials not directly related to placing Product orders.
- “Withdrawal Portal” (or “Return Portal”): Fairphone’s online self-service tool for cooling-off returns and commercial contract withdrawals, accessible at www.fairphone.com/returns.
4. What is not covered under Our Warranties?
4.1 Applicability Conditions. This Warranty applies only if:
- The Product was originally purchased at a physical retail store located within the Covered Territory, or delivered to an address within the Covered Territory;
- The Product is an original hardware product manufactured or distributed by Fairphone; and
- You operate the Product in accordance with Fairphone’s user manuals, technical specifications, and official guidelines.
4.2 Warranty Commencement. The Standard Warranty Period commences on the purchase date indicated on the original proof of purchase for in-store retail sales, or on the exact calendar date of physical delivery to the original Customer for online or distance sales (or the purchase date shown on the original proof of purchase if verifiable proof of physical delivery is unavailable).
4.4 Promotional & Bundled Items. Hardware items provided as promotional gifts or complimentary additions carry Standard Warranty coverage only when accompanied by valid proof of issuance. Promotional items are ineligible for cash refunds or Extended Warranty upgrades unless explicitly stated.
4.5 Contract Termination. If the original purchase contract or sale for a Product is canceled, terminated, or fully refunded (whether under Your statutory right of withdrawal or otherwise), all commercial Standard and Extended Warranty coverage for that Product automatically terminates. For further details on contract termination, refer to Our B2C Sales Terms and Conditions.
5. How to Obtain Warranty Service & Claim Procedures
5.1 Troubleshooting & Self-Repair Guidelines.
- Duty to Mitigate Damage. If You notice a defect or malfunction, You must stop using the Product and report the issue promptly. Continuing to operate a defective Product may cause secondary or progressive damage, making it impossible to diagnose or verify the initial failure under warranty.
- Diagnostic Tools & Repair Guides. Review Fairphone’s online support portal at https://www.fairphone.com/repairs for troubleshooting and self-diagnostic tools.
- Modular DIY Repair Rights. Fairphone hardware is explicitly designed for modular repairability. Replacing official modular Spare Parts Yourself in accordance with official Fairphone repair guides and using recommended tools will not void Your Warranty on the rest of the Product.
- Modular Disassembly Boundaries & ESD Safety. While Fairphone Products are designed for user replacement of official modular Spare Parts, individual Spare Parts are sealed components and are not designed to be opened or disassembled further. Any damage caused by prying open individual Spare Part assemblies, failing to use recommended tools, or neglecting Electrostatic Discharge (ESD) precautions is excluded from coverage.
5.2 Submitting a Warranty Claim.
- Purchased via Reseller. Contact the Reseller first with Your original proof of purchase. The Reseller will manage Your return, subject to Fairphone’s final coverage determination.
- Purchased via Fairphone Online Shop. To make a claim under this Warranty, You must notify Fairphone during the applicable Warranty Period by opening a request via our digital Repair Portal (www.fairphone.com/repairs) and obtaining a Return Merchandise Authorization (RMA). All returns, packaging, and shipping procedures are governed by the Fairphone Return Policy. Obtaining an RMA within the Warranty Period preserves Your claim, provided the Product is dispatched in accordance with the Return Policy.
- No Temporary Loaner Devices. Fairphone does not provide replacement or loaner devices during the diagnosis, repair, or fulfillment of a warranty claim.
- Third-Party Data Charges. You are responsible for any third-party data transmission, internet connection, or cellular roaming fees incurred when downloading software updates or troubleshooting guides.
5.3 Customer Data & Pre-Service Obligations
- Data Backup & Erasure Obligation. Before handing over any Product for service, You are solely responsible for independently:
- Backing up all personal data and files;
- Performing a full factory reset to permanently erase personal data;
- Removing all SIM cards and external micro-SD cards;
- Disabling all passwords, PIN codes, security locks, and biometric locks; and
- Removing all protective cases and third-party accessories.
- Data Liability Exclusion. Fairphone automatically wipes all received devices upon arrival at the Service Center. Fairphone assumes zero liability for lost data, corruption, unremoved security locks, or missing SIM/SD cards and third-party accessories left inside or on returned Products. Data recovery services are not offered.
5.4 Logistics and Shipping Costs
- In-Warranty Claims. For valid warranty claims within the Covered Territory, Fairphone will provide a prepaid return label and cover all logistics, professional labor, and material costs. Products must be sent exclusively to the designated Service Center specified on Your prepaid label.
- Unsolicited Returns Notice. Products sent directly to Fairphone’s corporate office address cannot be processed and will be returned or refused at Your expense.
- Out-of-Territory Policy. If You require warranty service from an Out-of-Territory location, the following rules apply:
- Prior RMA Required. You must register Your warranty claim and obtain an approved RMA before shipping. Shipments sent without an active RMA will not be processed or reimbursed.
- Standard Economy Cap. You are responsible for upfront shipping to Our Service Center. If technical diagnostics confirm a covered defect, Fairphone will reimburse shipping costs strictly capped at the rate of the least expensive standard tracked postal service offered by Your national postal operator.
- Carrier Exclusions. Fairphone will not reimburse express shipping, private couriers (such as DHL Express, FedEx, UPS, or TNT), freight forwarding, or optional insurance/delivery add-ons.
- Receipt Evidence. Reimbursement requires a valid, itemized receipt displaying the carrier's tax ID, package weight, and tracking number matching Your RMA.
- Non-Reimbursable Administrative Costs. Boxes, packing tape, travel expenses, and regional customs fees are not reimbursable.
- No Fault Found (NFF) & User Damage. If diagnostics reveal the device operates perfectly (No Fault Found) or the defect was user-induced, Fairphone will reimburse zero (0) logistical costs. The device will be returned at Your expense or recycled free of charge.
- Customs & Import Duties (Non-EU Customs Zones). When shipping from an Out-of-Territory region outside the EU Customs Union or special fiscal territory (such as the Channel Islands, Canary Islands, Ceuta, Melilla, or Isle of Man), You are responsible for ensuring Your package is declared properly as a temporary export for repair with Your RMA number visible. Fairphone covers standard customs fees for valid warranty repairs, but cannot cover additional taxes, penalties, or administrative fees caused by incorrect declarations or non-warranty claims.
- Non-Supported International Regions. Fairphone does not offer after-sales logistical support or shipping reimbursements for devices located in Non-Supported International Regions (such as Mexico or Canada). You are solely responsible for all cross-border shipping, tracking, customs duties, and import/export fees required to transport the device to and from an address within the Covered Territory.
5.5 Out-of-Warranty (OOW) Claims & Repair Quotes. If You submit a Product for service and technical diagnostics reveal that the defect is excluded from Warranty coverage under Section 9, or that the applicable Warranty period has expired, Fairphone’s Service Center will issue a standardized European Repair Information Form. This document outlines itemized costs for required spare parts, diagnostic labor, handling, and shipping before any repair is performed.
If You decline the repair proposal, Fairphone will offer You two options:
- Return of Product. The Product will be returned to You upon payment of the standard diagnostic, handling, and return logistics fees specified in the form.
- Free Disposal & Recycling. You may authorize Fairphone in writing to retain and recycle the Product free of charge.
5.6 Abandoned Property & Unclaimed Devices
- A Product submitted for service shall be deemed legally abandoned if:
- Unanswered Service Quotations. You fail to select a service option or pay applicable diagnostic, handling, or return shipping fees within three (3) months of Fairphone’s Service Center issuing a European Repair Information Form; or
- Undeliverable Return Shipments. If a Product returned following repair, inspection, or service cannot be delivered to Your address and You fail to provide a valid delivery address within sixty (60) days after receiving written notice and a subsequent final warning sent to Your registered email address, the Product shall be deemed abandoned.
- Consequences of Abandonment. Upon abandonment, Fairphone reserves the right to sanitize (erase all data), recycle, or dispose of the Product in accordance with applicable environmental laws. You remain liable for any accrued diagnostic, handling, storage, or administrative fees incurred prior to final disposal, less any net proceeds realized by Fairphone from recycling or liquidation.
5.7 Transferred Warranty / Second-Hand Owners. In the event You sell or donate Your Product, the new owner (“Second Owner”) can benefit from In-Warranty repairs and replacements for the remaining balance of the Warranty, provided they present valid original proof of purchase.
- Accepted Proof of Purchase. Only original sales receipts or tax invoices issued directly by Fairphone or a Reseller are accepted. Order confirmations, receipts, or screenshots from second-hand peer-to-peer platforms or private sellers do not constitute valid proof of purchase.
- Coverage Limits. Transferred warranty coverage cannot extend beyond the remaining duration of Your original Warranty period calculated from the original delivery or store purchase date.
- Refund Restrictions. Fairphone does not issue monetary refunds to second-hand owners. Transferred warranty coverage is strictly limited to In-Warranty repairs or hardware replacements.
6. Warranty Services Provided & Remedies
6.1 Available Remedies & Hierarchy.
6.1.1 If a defect in materials, design, or workmanship is confirmed during the applicable Warranty period, Fairphone will, at its sole discretion and as permitted by law, provide remedies in the following order:
- Repair. Repair the defective Product using new or factory-refurbished spare parts in good working order;
- Replacement. Replace the Product with an identical or factory-refurbished model;
- Equivalent Substitution. Substitute the Product with an equivalent model featuring equal or superior functionality if the original model is discontinued;
- Model Upgrade. Offer an upgrade to a successor model (a proportional surcharge may apply depending on the age, model, and condition of the defective Product); or
- Refund. Issue a full or partial refund of the purchase price.
6.1.2 Cash Valuation & Deduction for Use. Where a full or partial monetary refund is granted under these Warranty Terms, Fairphone reserves the right to calculate the product's current cash value by deducting a reasonable sum representing Your period of beneficial use and normal wear prior to the warranty claim.
6.2 Extended Warranty Remedy Scope. Remedies requested during an Extended Warranty Period are subject to the specific terms, registration requirements, and component exclusions set forth in Section 7 (including the exclusion of main device batteries). During the Extended Warranty Period, remedies are strictly limited to hardware repair or unit replacement; monetary refunds are granted only where technical repair or unit replacement is proven impossible.
6.3 Geographic Coverage & Cross-Border Logistics. Fairphone covers standard postage, repair center labor, and material costs for In-Warranty claims, provided the service is requested and delivered within Fairphone's Covered Territory.
- Out-of-Territory Claims. If You request warranty service from outside our Covered Territory, Fairphone will not cover international shipping, import/export customs duties, or clearance taxes. You must, at Your own expense and risk, arrange for the Product to be delivered to a valid address within our Covered Territory and arrange for return collection.
6.4 Refurbished Parts & Transfer of Ownership. In line with Fairphone's mission to reduce electronic waste:
- Refurbished Parts & Devices. Fairphone may use factory-refurbished spare parts or replacement units. All refurbished components are tested to ensure functional performance and appearance equivalent to new parts. Minor cosmetic marks from previous use that do not affect functionality may be present and do not constitute a defect.
- Transfer of Ownership. Any defective parts or whole Products replaced by Fairphone automatically become the legal property of Fairphone upon replacement. If You perform a self-repair, You are responsible for recycling replaced parts locally in accordance with municipal regulations.
6.5 Warranty Period Continuity & Legal Extensions. A repair or replacement under this Warranty does not restart or extend the original Warranty Period, unless a clock suspension or extension period is explicitly mandated by local consumer law (such as the automatic tolling of the statutory guarantee clock while the Product is physically held for repair, or mandatory extension periods following repairs under EU legal guarantee rules).
6.6. System Updates & Data Liability During Service. During servicing, Fairphone's Service Center may update the Product's operating system to the latest official release version.
- Software updates applied during repair cannot be rolled back to earlier versions and may affect third-party application compatibility.
- Fairphone is not responsible for backing up, transferring, or reinstalling personal data, media, or third-party applications. Reinstalling third-party software and restoring user data is strictly Your responsibility and falls outside the scope of Warranty services.
6.7 Commercial Spare Parts Availability. In accordance with EU Ecodesign requirements, Fairphone maintains commercial availability of essential modular spare parts on its Online Shop for at least seven (7) years following the date a Product model is retired from market placement. To the maximum extent permitted by law, Fairphone shall not be held liable for temporary stock shortages, unforeseen component supply disruptions beyond Fairphone's reasonable control, or force majeure events affecting immediate spare part fulfillment.
7. How will Fairphone help You get the most out of Your Warranty?
7.1 The following table sets forth the warranty coverage applicable to all Fairphone Products in the Covered Territory:

7.2 Cables and Chargers Extended Warranty Rules. The Extended Warranty for cables and chargers applies only to the following eligible Products:

7.3 Extended Warranty Registration Process. To benefit from an Extended Warranty (where applicable), You must register Your Product:
- Dual Eligibility Requirement: Extended Warranty coverage applies only if:
- The Product was acquired within the applicable Extended Warranty Offer Period specified in Section 7; and
- The Product is successfully registered online within its Registration Window of three (3) months from the store purchase date or physical delivery date.
- Late Registration Exclusions: Any registration attempt submitted after the expiry of the three (3) month Registration Window (or after the absolute Extended Warranty Cut-Off Date) shall be void, leaving the Product covered solely under the Standard Warranty Period.
- Submission Guidelines: Registration must be completed via www.fairphone.com/warranty or through the MyFairphone app by providing a valid IMEI/serial number and a legible original proof of purchase.
- Registration Requirements. Fill out the registration form within the applicable Offer Period, supplying the IMEI or serial number and a legible copy of Your proof of purchase (showing order date, complete product name, purchase price, and seller details). Each Product in a multi-item order must be registered separately. Proof of purchase must be retained and presented when submitting any warranty claim.
- Automatic Coverage & Swapped Device Continuity. Registration is free, applies once per IMEI/serial number, and cannot be exchanged for monetary value or alternative products. (Note: Extended Warranty for eligible Long-Life Cables and Chargers applies automatically upon purchase). If Fairphone replaces a Product under warranty, the Extended Warranty coverage automatically transfers to the replacement unit for the remainder of the applicable period without requiring re-registration.
- Data Accuracy & Disqualification. You are responsible for providing accurate and complete information; Fairphone assumes no liability for errors or omissions in the data You submit. If You encounter an error during registration, You must contact Customer Support immediately. Fairphone reserves the right to verify submissions and reject or revoke Extended Warranty coverage in cases of incomplete data, unreadable receipts, fraudulent activity, false information, or breach of these terms.
8. Software Specifications & Data Protection
8.1 Software Disclaimer. Fairphone does not warrant that pre-installed software (or subsequent updates) will operate uninterrupted, error-free, or compatible with non-Fairphone hardware/software. Software covered by separate End-User License Agreements (EULAs) is governed strictly by those agreements. You are responsible for any third-party data charges incurred while downloading software updates.
8.2 Custom OS & Bootloader Policy. Unlocking the bootloader or installing third-party alternative operating systems (e.g., custom open-source ROMs) does not automatically void Your hardware Warranty. Hardware claims remain valid unless technical diagnostics confirm that the hardware defect or failure was directly caused by custom software, unauthorized firmware flashing, or software-induced hardware stress.
8.3 Mandatory OS Reversion for Diagnostics. If Your Product is running a Third-Party Operating System, You must revert to official Fairphone OS prior to submitting an In-Warranty claim. Because diagnostic tools require standard software, Fairphone reserves the right to re-flash devices to official Fairphone OS upon receipt at the Service Center. Hardware or software recovery claims resulting from modified partitions that prevent restoring official Fairphone OS are strictly excluded.
9. What Is Not Covered (Warranty Exclusions)
9.1 This Warranty does not cover:
9.1.1 Wear and Tear, Consumables & Display Malfunctions
- Normal Wear and Tear. Natural deterioration of consumable parts (including ear cushions, eartips, headband coatings, and protective finishes) over time, unless failure occurred due to a defect in design, materials, or workmanship.
- Battery Degradation Threshold. Natural battery capacity loss over time is normal. A battery failure is covered under warranty only if maximum charge capacity drops below 70% of its original design capacity within the applicable battery warranty period specified in Section 7 under Normal Customer Use.
- Cosmetic Damage. Dents, scratches, discoloration, or surface wear in decorative, structural, or non-operative parts resulting from Normal Customer Use that do not impair functional performance.
- Display Malfunctions & Screen Burn-In. Minor display anomalies involving up to eight (8) defective pixels per million pixels, as well as screen burn-in (image retention) resulting from the continuous action or long-term display of static images.
9.1.2 Misuse, Abnormal Operation & Environmental Factors
- Non-Customary Usage. Usage of the Product other than in its normal and customary manner, including physical cuts, structural damage from excessive bending, lack of adequate ventilation, blown fuses, or exposure to electrical power sources with severe voltage spikes or surges.
- Environmental & Liquid Exposure. Damage caused by improper storage, exposure to liquids, moisture, dampness, or prolonged exposure to extreme heat or cold.
- Abuse, Vandalism & Accidental Damage. Failure caused by abuse, vandalism, misuse, or accidental damage (defined as any sudden, external, and unforeseeable destruction or deterioration preventing proper operation).
- Force Majeure & External Causes. Damage resulting from natural or man-made disasters (e.g., tsunamis, earthquakes, wildfires), extreme weather conditions (e.g., flooding, windstorms), physical collisions, or the intrusion of foreign particles (e.g., sand, dirt, dust).
9.1.3 Third-Party Hardware, Software & Network Infrastructure
- Non-Fairphone Products & Accessories. Use of the Product with non-Fairphone hardware, third-party modules, or third-party batteries, with the sole exception of compliant third-party chargers meeting Fairphone's technical specifications.
- Cellular Network & Antenna Reception. Defective functioning of external cellular networks, carrier infrastructure, or inadequate signal reception by external antennas, unless directly caused by a manufacturing defect in the Product’s internal hardware.
- Malware & Software Partition Modifications. Software instability, system corruption, or failure caused by computer viruses or malware. While unlocking the bootloader is permitted under Section 8, this Warranty excludes hardware or software recovery claims resulting from modifying system/Android partitions when flashing a Third-Party Operating System that renders it impossible to revert to the official Fairphone software version.
9.1.4 Repairs, Third-Party Repairers & Self-Repair Boundaries
- Unauthorized Modifications & Testing. Damage resulting from improper testing, maintenance, installation, or unauthorized alterations.
- Third-Party Repairer Liability Shield. For services or repairs performed outside Fairphone’s official repair flow (as outlined in Section 5), the third-party service provider ("Repairer") bears sole legal responsibility for the quality, safety, and outcome of the repair. Nothing in this Warranty shall be construed as Fairphone certifying, approving, or endorsing any third-party Repairer's qualifications, work, or business practices.
- Exclusion of Repair Damage. Fairphone assumes zero liability for any damage (including personal injury or property damage) resulting from:
- Improper repair services performed outside Fairphone's official flow;
- Use of incorrect professional tools, or spare parts not purchased directly from Fairphone’s Online Shop; or
- Misuse of published repair guides or technical documentation.
(This exclusion applies fully to self-repairs that do not follow the official procedures established in Section 5.1).
9.1.5 Logistics & Transport Hazards
- Customer Return Transport Risks: Loss or damage occurring during the transportation of the Product from You back to Us, unless shipped strictly using Fairphone’s official prepaid return labels and designated carriers in accordance with Section 5.3.
9.1.6 Fraud, Illegal Acts & Statutory Force Majeure
- Stolen & Locked Devices. Products linked to fraudulent or unlawful activities, including stolen products, or any Product for which You cannot disable anti-theft security measures/remote locks and cannot demonstrate authorized ownership.
- Missing Proof of Purchase. Products for which an original proof of purchase is not available shall be considered linked to unverifiable or fraudulent sourcing and are strictly excluded from coverage.
- War, Terrorism & Prohibitions. Damage caused by Your participation in acts of terrorism, war, riots, civil unrest, or popular movements, as well as Your conscious non-observance of official government prohibitions.
- Gross Negligence & Recklessness. Any claims arising directly from fraud, gross negligence, recklessness, or intentional misconduct by You or any third party.
9.1.7 Catastrophic Risks, Radiation & Hazardous Environments
- Electromagnetic Radiation & Personal Injury Claims. Device damage, functional failure, or personal injury liability arising directly or indirectly from exposure to abnormal electromagnetic radiation, ionizing fields, or non-standard external electromagnetic sources.
- Nuclear Reactions & Radioactive Contamination. Loss, damage, or malfunction directly or indirectly caused by nuclear reaction, nuclear radiation, ionizing radiation, or radioactive contamination (including during transit or marine cargo handling).
9.1.8 Ownership Verification & Device Identifiers
- Security Measures & Remote Locks. Products for which anti-theft security measures, remote locks, or personal security credentials cannot be disabled and authorized ownership cannot be verified.
- Altered or Defaced Identifiers. Products where serial numbers, IMEI identification marks, or official compliance labels have been altered, defaced, tampered with, or removed.
9.2 Specific Voiding Events. In addition to the exclusions outlined in Section 9.1, coverage under this Warranty shall be deemed null and void in any of the following events:
- Unauthorized Modification. Any term or condition contained in this Warranty document, or any associated proof of purchase, has been altered, defaced, or modified without the express prior written consent of Fairphone.
- Failure of Timely Notification. You fail to notify Fairphone or its authorized service center of the alleged defect or malfunction within the applicable Warranty Period.
10. Limitation of Damages & Liability
10.1 To the maximum extent permitted by applicable law:
- This Warranty constitutes Your sole and exclusive commercial remedy against Fairphone.
- Fairphone’s total financial liability under this Warranty shall be limited to the actual cash value or purchase price paid for the Product.
- To the maximum extent permitted by applicable law, Fairphone’s liability under this Commercial Warranty is strictly limited to the duration of the applicable Warranty Period specified in Section 7. Nothing in this clause shall restrict or limit Fairphone’s statutory liability under mandatory applicable national laws or statutory legal guarantees.
- Fairphone shall not be liable for special, incidental, consequential, or indirect losses, including loss of profits, revenue, business, data, or downtime.
- Nothing in this Warranty excludes or limits Fairphone’s liability for death, personal injury caused by negligence, fraud, gross negligence, or any liability that cannot be lawfully excluded under applicable law.
11. General Provisions
11.1 Data Protection & Privacy. Personal data collected in connection with warranty claims or repair requests will be processed in accordance with the EU General Data Protection Regulation (GDPR - Regulation EU 2016/679), the Dutch GDPR Implementation Act (Uitvoeringswet AVG), and applicable local privacy laws, as further detailed in the Fairphone Privacy Policy. By submitting a Product for service, You acknowledge and agree that data stored on the device may be erased during service procedures, as detailed in Section 6.5.
11.2 Entire Agreement & Reseller Scope. No agent, employee, reseller, carrier, or third-party distributor of Fairphone Products is authorized to modify, extend, or grant any additional warranties binding upon Fairphone. Any oral or written representations made by third parties that conflict with or expand upon the terms set forth in this Warranty shall be null and void and non-binding on Fairphone.
11.3 Governing Law. This Warranty is governed by and construed in accordance with the laws of The Netherlands. As a consumer, You will continue to benefit from any mandatory statutory protections provided by the laws of Your country of residence.
11.4 Dispute Jurisdiction. In the event of any dispute or claim arising out of or in connection with this Warranty, You may choose to submit judicial proceedings to either the competent court in Amsterdam, The Netherlands, or the competent court in Your place of residence.
