Welcome to the Fairphone Privacy Policy. This text explains what personal data we, Fairphone, collect, why we collect it and what we do with it.

With Personal Data (‘Your Data’) we mean any information through which we can identify you.
In general we collect Your Data to do what you ask us to do: send you your Fairphone, provide support, send you our newsletter or to see how you use our services, such as our website, so we can improve them.
We never sell Your Data, give it to someone else or use it for advertisement purposes without your approval.
This Privacy Policy applies to the website fairphone.com (including Fairphone webshop, forum, blogs and Fairphone support platform) owned and operated by Fairphone B.V.
This Privacy Policy covers how we collect and use Your Data. We are the controller of Your Data under this Privacy Policy and we will collect and process Your Data strictly in accordance with this Privacy Policy.

Data of children
We do not intentionally collect information from children under the age of 16.
- If you are under the age of 16, we advise you to speak with your parent or guardian and get their consent before sharing Your Data with us;
- If you are the parent or guardian of a child under the age of 16, we recommend you make sure that your child does not share Personal Data through the use of our products, services, website and other digital channels without asking your permission.
Sharing Your Data
We will never sell Your Data or information about you to any third parties.
We do not share Your Data except in the limited cases described in this section and only for the following purposes.
- Service providers: We have outsourced certain business functions and their associated data processing activities to third party service providers. These service providers are authorized to use Your Data only as necessary to fulfil these services to us, which include, but is not limited to IT services, advertising services, billing services and shipping services. None of these providers will contact you by electronic means to provide you with any newsletter, marketing e-mail or information, unless you have provided your consent to them;
- Business Partners: we may share Your Data with business partners, so that they can provide you with the services you requested. None of these partners will contact you by electronic means to provide you with any newsletter, marketing e-mail or information, unless you have provided your consent to them;
- Professional advisors and others: we may share Your Data with banks, insurance companies, lawyers, auditors, and other professional advisors. These parties only receive Your Data when this is needed to fulfil a contractual obligation.
- Public and governmental authorities: when required by law, or as necessary to protect our and/or your rights, we may share Your Data with entities that regulate or have jurisdiction over Fairphone;
- Affiliates: should Fairphone establish affiliates, we may share Your Data with those affiliates on a need-to-know basis;
- Social Media Plug-ins: our website does not use social media plug-ins. The social media symbols on our website are normally linked and do not transmit data to social media platforms.
Location of Your Data
We attempt to collect, store and, if applicable, process Your Data within the European Union, European Economic Area (“EEA”) and Switzerland.
We may transfer Your Data to countries located outside the European Union, European Economic Area (“EEA”) and Switzerland. Some of these countries are recognized by the European Commission as providing an adequate level of protection. With regards to transfers to countries which are not recognized by the European Commission as providing an adequate level of protection, we will ensure adequate data protection and privacy requirements through the standard contractual clauses approved by the European Commission. Data retention
We will not store Your Data for a longer period than permitted by law and only as necessary for the purpose for which we have collected or processed Your Data. Therefore, how long we retain Your Data depends on the type of data and the purpose for which we collected or processed Your Data. Please keep in mind that in certain cases a longer retention period may be required or permitted by law.
The criteria we take into account when determining our retention periods include:
- How long Your Data is needed to provide you with our product or to operate our business;
- Do you have an account with us? If yes, then we will keep Your Data while your account is active or for as long as needed to provide our services;

We process Your Data in accordance with the General Data Protection Regulation. To protect Your Data, we will take appropriate measures, including requiring our service providers to use appropriate measures to protect the confidentiality and security of Your Data. Your Data is stored on our secure servers or the servers of our trusted partners.
Although we want you to feel confident in using our website and we are committed to protecting the Your Data we collect or process, no website can guarantee complete security. We have implemented appropriate technical and security procedures to help protect Your Data against any unlawful destruction, accidental loss, alteration or unauthorised disclosure or access. However, please be aware that the transmission of information and data over the Internet is inherently insecure, and we cannot guarantee the security of data sent over the Internet.
Your responsibilities
When providing us with Your Data, it is your responsibility to ensure that Your Data is accurate, complete and up-to-date. You should also take all reasonable measures to keep Your Data secure at all times. For instance, you are responsible for keeping your password and other log-in details confidential. We will not ask you for your password, except when you log into our website.

In order to be able to send you your Fairphone 2, we need you name, address, phone number, e-mail address and payment data to complete the purchases.
We store the IMEI number of the Fairphone you bought.
Please note that that when you use third party payment providers, such as PayPal and Buckaroo, their Privacy Policy is also applicable to the monetary transaction.

You can request to have Your Data removed by sending an e-mail to privacy@fairphone.com. You might be requested to send us a proof of identity before we proceed with the deletion process. If you request more data to be deleted in the same request, we might ask you to provide us with additional proof of identity to ensure we are deleting the right data. Please bear in mind that some data, like the one associated with a past purchase, cannot be deleted because of our legal obligation to provide a two-year warranty or our obligation to maintain financial Data for 7 years.

Your information will be deleted after three months and not be used for other purposes than the ones mentioned above.

Pictures, video and other media materials of individuals.

Fairphone regularly takes photographs and makes videos (hereafter: materials) during the events we organize and attend.
What do we use Your Data for?
These materials are used:
- To report on the event through our blog and social media accounts; and
- To promote future events.
When do we delete Your Data and how can you request Your Data to be deleted?
During events at our office, you will always be able to tell us that you do not want us to use materials in which you are clearly identifiable.
During the events of other organizations, we will use a release form to ask for your consent to use the materials in which you are clearly identifiable. This only applies to materials Fairphone makes and does not apply to the materials made by the organizer of the event and/or other attendees.
If you are identifiable in our videos and pictures and you want us to remove such materials, you can send a request to privacy@fairphone.com.

When a product is unavailable for a period of time, we add a form to the product page. You can use this form to fill in your details and you will receive an e-mail when the product is available again.
What we use Your Data for:
To notify you when a product has become available again. We always send out an update and a reminder a few days later.

After we have sent you the reminder email, we delete your email address and any other information we have of you.

What Personal Data do we collect?
- Username
- Name (if provided)
- Logins (if you connect your forum account to a social media account)
- The last IP address you used to login
- The IP address you used at the moment of sign-up
- If you have 2-factor authentication enabled
- What Fairphone model you have (if provided)
- Account status, capabilities and trust level.
- Group membership
- Activity: creation date, last notification send, last seen, number of likes given/received, number of posts created, warnings received, private topics created, total read time, total number of days visited on the forum
- The contents of your private messages to other forum users can be read by the administrators of the forum
- Any data you disclose by adding posts and data to the forum.
How do we collect Your Data?
Your Data on the Fairphone forum is collected through the sign-up form and through registration of your actions on the forum.
What do we use Your Data for?
- To enable you to create an account and to validate that account;
- To monitor the popularity of our forum and make adjustments if needed;
- To fight spam, false logins, trolls and other behaviour that violates our forum rules;
- To help resolve any disputes forum members are unable to solve between them.
When do we delete Your Data and how can you can request Your Data to be deleted?
We can only delete your account if you have not made any posts. First delete your posts if you want Your Data removed. Posts older than 60 days cannot be deleted in order to protect the coherence and reliability of our forum.
If you have posts that are older than 60 days, Your data can be anonymized upon request. You are able to download an archive of Your Data from your profile page before it is anonymized.

After the purchase of a Fairphone 2, we send you an email with a link you can click to fill in our survey.
At the end of the survey you can opt-in to allow Fairphone to contact you for other surveys and consumer panels.
What do we use Your Data for?
We use Your Data to better understand our customers, what motivates them to buy the Fairphone 2 and how we can improve our company and product. If you consent, we also use this data to contact you again in the future with more questions, surveys or interviews.
When do we delete Your data and how can you request Your Data to be deleted?
We analyse and aggregate individual responses every month into anonymized datasets. After aggregation has been completed, individual responses and all Your Data are deleted.
If you consented to be contacted again in the future, we store your e-mailadres in our mailing list database. At the bottom of every email you receive from us, you can find an opt-out link which will remove Your e-mailadres from the mailing list.

The Personal Data that is provided by applicants is stored in our Application Tracking System Homerun, which is also our recruitment database.
What do we use Your Data for?
Your Data is only used to communicate with you with regard to your job/internship/open application:
- Request additional information concerning a new job/internship opportunity and/or assessing the application;
- Inform about job/internship opportunities.
If hired, our People team will process the information as necessary in relation to the your employment and your information will be transferred to your personnel file. This is limited to information relevant to the ongoing employment relationship.

If an applicant has consented, we keep their Data for a period of 12 months. The Fairphone People team is responsible for the deletion of applicant Data from Homerun after 12 months have passed.
If no consent has been given, Personal Data is deleted 3 months after a decision on the position has been reached.
Welcome to the Fairphone Device and Application Data Collection page. This text explains what data we, Fairphone, collect through your Fairphone device, why we collect it and what we do with it. With personal data (‘Your Data’) we mean any information through which we can identify you. In general, we collect Your Data to provide you with a secure and up-to-date device and to provide you our services.
In the below page, we will explain the different privacy options we provide and we will clarify when and where you can provide your privacy preferences :

Setting up your Fairphone
Once you start your device, you will be guided through a series of privacy options. In the below section we explain in more detail what these options entail.
While we aim to provide you with control over your personal data and other data sent by your device to us, some data is required to ensure your device is secure, up to date, and performing as expected. In addition, this data also allows us to estimate how long a device is used and updated, which is core to Fairphone’s mission to increase the longevity of devices and reduce environmental impact. This data is sent by your device regardless of the privacy settings you have set and is collected on a legitimate interest basis. It includes the following data points:
- serial numbers of devices: This allows us to recognise the device and batch;
- device activation: it allows us to see the number of devices activated, which helps us
provide service to you in a number of ways:- Allows us to create a baseline so that we can recognise quality or security issues
in devices more quickly; - Allows us to see how many of the devices we sold are active in the field, which
can be used to determine the correct course of action. For example, does an
issue occur in all devices or certain batches, and are the affected devices in the
hands of our customers. - Allows us to plan spare parts production more effectively to minimise waste at
the end of life;
- Allows us to create a baseline so that we can recognise quality or security issues
- software version, model and brand: In combination with the other data points, it allows us to evaluate which devices are running the latest software, which devices require
updating and if a security or other software issue is specific to a software version.

During the set-up of your device, you can opt-in to providing us with additional information to improve our ability to diagnose security and quality issues. This information includes:
- IMEIs: IMEI numbers are added to devices at production and are used by our operations team to send devices to our customers and provide customers with services, such as warranty service and extended warranty service.
- operator name: this would allow us, for example, to recognise if an issue occurs with a certain operator; and
- cell tower and network data: this would allow us, for example, to recognise if an issue is specific to a certain country.
MyFairphone App
Apart from the device set-up, the Fairphone 3 and Fairphone 4 comes with a native application called the MyFairphone App. When you open this application you will be required to opt-in to the MyFairphone App Privacy Statement. Depending on who you are and what features of the My Fairphone App you use, we may process different categories of Personal Data about you. When uploading pictures or using the MyPlanet section of the MyFairphone App, your device will request the required permissions. You can also disable the MyFP app, which will remove it from the apps screen and stop it from running in the background, so it will also no longer receive updates. For more information, please read the MyFairphone App Privacy Statement.
Push Notifications
You may receive push notifications from the MyFairphone App. These notifications, currently include:
30-day NPS Survey: This push notification opens a survey on a website hosted by Typeform. We send you this one-time notification 30 to 45 days after your device has been activated so we can ask you some simple questions about your experience with Fairphone so far.
5 Year Warranty Reminder: This push notification redirects you to the 5 year warranty registration page. The 5 year warranty requires registration and through these reminders we help ensure you can make use of the 5 year warranty.
Longevity Survey: This push notification redirects you to the survey in a typeform format. The survey collects the answers to the questions along with the Fairphone model, OS version, serial number, at what time the survey has been started, at what time the survey has been finished and the Network ID. We use the responses to the survey to calculate how long our customers intend to use the Fairphone device and what Fairphone can do to improve the longevity of the device.
Green Challenges: If you choose to participate in a green challenge through the My Fairphone App, then you will get a notification asking whether you have completed the Green Challenge or not.
This section does not include push notifications received from the Android Operating System or from Third Party applications.
You can manage your push notification preferences at any time or disable these notifications at any time by turning off the notification settings in the MyFairphoneApp or in the Device Settings of your mobile device.
Device Settings
In the device setting, you can control the privacy settings of your device:
Settings > Privacy > Advanced > Longevity & device statistics.
You will be able to opt-out of this data collection at any time. In this section, you can also provide us with consent to collect data for marketing purposes. This data is not used to target you specifically but will instead be used to analyse our customers more generally.
